Merchant Terms & Conditions

1. The FedEx Promotional Offer (“Campaign”) is jointly organized by Federal Express (“FedEx”) and shall be governed by these Terms and Conditions, and any additional terms FedEx may impose. By participating in this Campaign, you are deemed to accept these Terms and Conditions.

2. To be eligible to participate in this Campaign, participants (“Participants”): Must not have an existing FedEx Business account.Must open a new FedEx Business account online during the Campaign Period.

3. A Participant’s entry into this Campaign is confirmed by receipt of an email notification from FedEx confirming the opening of a new FedEx shipper account (the “Confirmation Notice”).

4. A Participant who has successfully opened a FedEx account in accordance with Clause 2 will be entitled to receive the discounts and benefits outlined below.

5. A promotional discount (“Promotional Discount”) as specified on the FedEx.com offer page and in the Confirmation Notice, applied to the list- priced basic freight charge of each Eligible Shipment (as defined below). The Promotional Discount does not apply to other charges, such as duties, taxes, fuel surcharges, duty & tax surcharges, or other surcharges.

6. For the purposes of this Campaign, “Eligible Shipments” must meet all of the following requirements: Shipments must be invoiced to, and settled by, the FedEx shipper account specified in the Confirmation Notice to qualify for the Promotional Discount.Shipments must meet the criteria specified on the FedEx.com offer page for the Participant’s market and as detailed in the Confirmation Notice.Shipments must be tendered during the Campaign Period, as specified in the Confirmation Notice.Shipments must be one of the following services: FedEx International Priority Express (IPE), International Priority (IP), International Priority Freight (IPF), International Economy (IE), International Economy Freight (IEF), International Priority Letter (IP LTR), or International Priority Pack (IP PAK).

7. The Promotional Discount cannot be used in conjunction with any other shipping discount or offer provided by FedEx.

8. In the event of any inconsistency between these Terms and Conditions and any brochure, marketing, or promotional material relating to this Campaign, these Terms and Conditions will prevail.

9. If this Campaign cannot run as planned due to reasons such as tampering, unauthorized intervention, fraud, technical failures, or other causes beyond FedEx’s control that affect its administration, security, fairness, integrity, or proper conduct, FedEx reserves the right to cancel, terminate, modify, or suspend the Campaign at its sole discretion.

10. The terms and conditions of carriage in the applicable FedEx Express Air Waybill, in effect on the day of shipment, shall apply. If there is a conflict between the FedEx Express Air Waybill and these Terms and Conditions, the former will control.

11. In the event of any discrepancies regarding this Campaign, FedEx’s decision is final, and no further correspondence will be accepted. FedEx will not be obliged to act contrary to applicable laws or regulations.

12. FedEx reserves the right to amend these Terms and Conditions at any time without notice.

Visa Terms and Conditions

Offer details as shown are based on information provided by the Merchant. No warranties are made by Visa that the information is correct. Please check directly with Merchant to confirm the availability and validity of the Offer.

1. The Merchant is the sole provider of all goods and/or services under this offer. Accordingly, the Visa Cardholder understands, acknowledges and agrees that the procurement by him/her of any goods and/or services under this Offer shall constitute a contract solely between the merchant and him/her, and Visa is not, nor will become, a party thereto.

2. By utilizing or attempting to utilize any of the goods and services under this Offer, the Visa Cardholder understands, acknowledges and agrees that:

Any claim, complaint or dispute of any nature arising out of or in relation to the procurement, or attempted procurement by the cardholder of any goods and/or services under this offer (each a “Claim”) shall be settled by the Visa Cardholder directly with the Merchant, and Visa Cardholder shall not make any Claim against Visa.

Without prejudice to the foregoing, and to the fullest extent permitted by law, Visa shall not be liable to any person for any loss, damage, expenses or claim (whether direct or indirect) in relation to any personal injury, death, false representation, damage or omission arising from or in connection with the usage or attempted usage of the Offer or goods and/or services provided under the Offer.
