EastWest foodpanda Visa Cash Back Program 
Terms and Conditions

A. Definition of Terms: 

1. "Bank" refers to East West Banking Corporation. 

2. "Card" refers to the EastWest foodpanda Visa credit card issued by the Bank pursuant to its license by Visa Worldwide Pte. Limited. 

3. “Card Account” refers to the account maintained in relation to the Card. 

4. "Cardholders" refer to the persons to whom the Card was issued. 

5. “Principal Cardholders” refer to the person or entity in whose name the Card is primarily opened and maintained. This individual is solely responsible for all transactions, debts, and fees incurred on the primary card and any supplementary card issued under that account. 

6. “Supplementary Cardholders” refer to an authorized secondary user of a credit card, receiving a card issued under a principal cardholder's card account to share the credit limit and benefits. The supplementary cardholder can use the card for purchases and earn Cash Back but will be lodged in the primary cardholder’s card account. 

7. “Cash Back” referred to as Points hereafter, means the Cash Back earned through usage of the Card as specified in this Terms and Conditions, which can be redeemed as determined by the Bank. 

8. "Program" refers to this EastWest foodpanda Visa Cash Back Program extended to the Cardholders. 

9. "Transaction" means any retail, straight charge or merchant installment purchase/transaction successfully charged to the Card. 

10. "Good Standing" means accounts that are current, ​​active, not cancelled, not delinquent, not under investigation due to suspected fraudulent activities, not reported as lost or stolen and those who have not, otherwise, violated any of the Terms and Conditions Governing the Issuance and Use of EastWest Credit Cards. 

11. “Billing Cycle” means the period between two consecutive billing dates on a credit card account. It typically lasts around 30 days, with the exact duration as defined by the Bank. 

12. "Merchant Category" means the classification of each merchant establishment as determined by the Acquiring Bank based on the nature of the merchant’s business, as defined by Visa. 

13. “Panda Pro” refers to the loyalty program of foodpanda where members who subscribe are provided with exclusive deals and benefits on foodpanda services. 

14. “foodpanda wallet” also known as “pandapay” is a digital ​closed-loop ​wallet integrated into the foodpanda app where members can receive and use funds for foodpanda orders  

15. “Qualified transaction” refer​s​ to transactions that are eligible to earn Cash Back. 

16. “Cross-border” refers to a transaction where the cardholder's account and the merchant's account are in different countries across international borders with foreign currency conversion.  

 

B. ​​​Membership Eligibility and Participation 

1. The Card Account is entitled to participate in the Program from the date when the Card is issued provided that the Card Account is and remains in good credit standing as determined by the Bank. 

2. The Program is open to ​​all Principal Cardholders in good standing unless otherwise determined by the Bank.

​​3. The Card is intended solely for personal, family, or household use. It is not designed for business or commercial purposes. Any use of the Card for business or commercial transactions is strictly prohibited and may result in the suspension or termination of the Card, ​as well as the ​forfeiture and clawback of any Cash Back earned and redeemed. ​ 

​​​​​​​4. Except for the first year, the ​​Cardholder will be billed the Annual Membership Fee of Php 1,200 every card anniversary for every Principal Account and Php 600 for the Supplementary Account. 

 

C. Earning of Cash Back 

1. To earn Cash Back, a Cardholder must use the Card to purchase items, goods and services. The earn rates that will apply are as follows:

2. Earned Cash Back is equivalent to Php 1​.​

3. Earned Cash Back for each Billing Statement will be reflected in your Statement of Account (SOA). All points indicated on the SOA is considered correct unless a formal dispute is submitted via authorized channels. 

4. Transaction which are not eligible to earn Cash Back include but are not limited to Cash Advance and other availments of the Bank’s loan programs (Insta-Cash, Balance Transfer, Convert-to-Installment and Balance Conversion), all fees and charges, traveler’s check or casino chip purchases. 

5. Returned or refunded purchases, disputed, unauthorized or fraudulent transactions, interest charges, card account fees and charged-back transactions are not eligible for Cash Back Points. The Bank reserves the right to reverse any Cash Back Points earned on these transactions. 

​​​​​​​​6. Transactions made by the Supplementary Cardholder/s shall form part of the Principal Cardholder’s transactions and shall qualify for Cash Back Points under this Program. 

7. Merchant Installment transactions earn Cash Back but only for the portion of the monthly installment amount billed or reflected on the Statement of Account.

8. If a Card is terminated at any time and/or for any reason, whether by the Cardholder or the Bank, all Cash Back Points earned ​subsequent t​o the termination ​​shall automatically be forfeited in favor of the Bank​.​

9. Transfer of Cash Back Points to another EastWest credit card variant shall not be allowed. 

10. All transactions related to the earning of Cash Back are subject to ​​these​​​​ ​​ terms and conditions. 

 

D. Redemption of Cash Back 

1. Cash Back earned will be credited (auto-credit) to the ​​​​​Principal ​cardholder’s pandapay wallet account that has the same e-mail address as the one provided by the cardholder to the Bank upon Card application 

2. Only Card Account in good standing with sufficient Cash Back will be entitled to receive the earned Cash Back the cardholder’s pandapay wallet, subject to applicable pandapay terms and conditions 

3. In the event that the e-mail address provided by the cardholder to the Bank does not match with any of the e-mail addresses in foodpanda customer database, Cardholder must create a new foodpanda account using the same e-mail address as the one provided to the Bank 

4. The timing of auto-credit is pre-set by the Bank on a banking day and will be done weekly or on a regular interval as determined by the Bank

5. Cardholders will receive an in-app notification pushed by foodpanda for Cash Back that have been successfully credited 

6. Once the auto-credit has been processed, the request cannot be revoked or cancelled and the Cash Back cannot be transferred back into the Card Account 

​​​​​​7. Cash Back earned cannot be used to pay for Annual Membership Fee or redeemed as Cash Credits to pay off your Statement of Account and will not be considered as payment to the Card Account​.​ 

8. Redemption of Cash Back that are successfully auto-credited to the pandapay wallet that matches the e-mail address you provided to the Bank will be subject to the procedures, rule and regula​tions of pandapay wallet. The Bank will not be held liable for any changes made by pandapay on their terms and conditions. 

 

E. General Terms

1. The Bank is authorized to disclose personal information of the Cardholder or details of the Card Account to third parties strictly for purposes of administering the Program, subject to compliance with the Bank’s Data Privacy Statement and applicable laws, including the Data Privacy Act of 2012. The Cardholder’s consent to such disclosure shall be obtained upon application. The Bank shall ensure that any disclosure is limited to what is necessary for the stated purpose and that appropriate safeguards are in place.”.  

2. Any fraud and abuse in the use of the Card and/or the Cash Back Points may, in the sole discretion of the Bank, result in forfeiture of the Cash Back Points, suspension, or termination of the Card of the Cardholder. For the avoidance of doubt, a Cardholder who makes an overpayment or advances a payment exceeding their credit limit in their Card account may constitute abuse in the use of the Card. 

3. Any request for adjustment of Cash Back is subject to the bank’s ​review and ​approval​. ​ ​ ​​The ​decision to grant or decline ​ ​​such ​request ​ ​​shall ​be at the bank’s​ sole and​ absolute discretion. 

4. ​​​The Bank may at any time revise, cancel, or terminate the Program.

5. The Cardholder agrees to comply with all applicable laws, rules, and regulations in the use of the Card. The Bank reserves the right to take appropriate action, including but not limited to, the immediate termination of the Cardholder's account and the forfeiture of all accumulated Cash Back points, if the Cardholder is found to be engaging in any illegal activities or violating any applicable laws and regulations. The Bank shall not be liable for any loss or damage resulting from such termination and forfeiture​ ​​in good faith and without any fraud or other wrongful conduct on its part.​​ ​ 

6. The Bank makes no representation for foodpanda or Delivery Hero and all feedback regarding the quality of the goods and services provided should be directed to foodpanda​. ​​The Cardholder​ shall hold the Bank free and harmless against any and all liability arising from any loss or damage that ​Cardholder​ may suffer as a result arising from or in connection with the use of such goods or services without any fraud or other wrongful conduct on its part.​​​​ 

7. ​​​​​​The Bank shall not be held responsible for any delay or failure to perform any of its obligations under this Agreement to the extent that such delay or failure results from any cause beyond the Bank's reasonable control, such as, but not limited to, acts of God, acts of war or terrorism, fires, storms, floods, epidemics, government restrictions, adverse weather, failure of any machine, data processing system or transmission link without fault or negligence on its part or events of nature.​​​​​ 

8. Terms and conditions indicated in the Terms and Conditions Governing the Issuance and Use of EastWest Credit Cards shall​ likewise​ apply.  

9. These terms and conditions shall be governed by Philippine laws and any should be resolved under the exclusive jurisdiction of the courts of Taguig City, Philippines. 

10. The Bank reserves the right to amend, modify, or change the Terms and Conditions of the Program at any time. Any changes to the Terms and Conditions will be communicated to Cardholders through one or more of the following methods: 

1. Email Notification: Cardholders will receive an email detailing the changes to the email address registered with the Bank. 

2. SMS Notification: A text message will be sent to the Cardholder's registered mobile number. 

3. Website Announcement: Updates will be posted on the official EastWest Banking Corporation website.
