EASTWEST INTERNET BANKING AGREEMENT

I. General Provisions

1. I hereby enter into the EastWest Internet Banking Agreement that allow the Bank's Client to avail the services offered by the EastWest Internet Banking facility subject to the provisions described below. I agree to abide by all existing provisions, regulations and procedures governing the operation of this Agreement.

2. Bank Account/s. I shall be allowed to avail of this facility for as long as I have existing Savings, Demand and Term Deposit accounts with any branch of the Bank.

3. Operational & Control Procedures. In order to activate my access to East West Internet Banking facility I/we shall visit a PBC where I/we maintain accounts to sign the Online Banking Enrollment Form and this Agreement.

II. Access to EastWest Internet Banking Facility

1. EastWest Bank shall provide me/us online instructions on how to avail of this facility. I shall nominate a USER ID and a unique and valid PASSWORD (at least six alphanumeric characters) in order for me/us access all my/our enrolled Savings, Demand and Term Deposit accounts through the Internet.

2. I can access my/our enrolled accounts anytime of the day, seven days a week. However, EastWest Internet Banking facility may not be available at certain times wherein systems maintenance is going on. Online transactions, such as fund transfer and bills payment transactions will be tagged incomplete. All transactions made on Saturdays, Sundays and Holidays will be posted and treated as transactions of the next banking day.

3. Only my Savings, Demand and Term Deposit accounts that I/we specifically enroll shall be provided with this facility. I fully understand that if the enrolled account/s belong to more than one person (i.e as in the case of "and/or" accounts), each and every one of the account owners shall be jointly and severally responsible for all the transactions involving the use of this facility and the terms and conditions herein.

III. User ID and Password usage

4. Upon nomination of my/our User ID and a unique and valid password, I will keep them private and secret, especially the password. I will not let anyone know of my/our Password. I assume the full responsibility for all internet banking transactions made in my/our account/s. The Bank shall conclusively presume that all these transactions are authorized by me/us through the use of my/our User ID and Password.

5. I will change my/our password periodically through the Internet Banking Change password option as I deem necessary especially in cases where my/our Password has been compromised.

6. I agree that the Bank shall act on the instructions received via this facility, based on its own discretion and that the Bank reasonably believes that all these instructions emanated from me/us through the use of my/our User ID and Password. The Bank shall not be liable for any actions taken based on the instructions received through the use of my/our User ID and Password.

IV. EastWest Internet Banking Services

7. I fully understand that the following are the services available in East West Internet Banking facility:

   1. Account Balance Inquiry. By clicking on the account number I can view the Available Balances and the Current Balances of my/our account as of access time.

   2. Transaction History Inquiry. I can view the transaction history of my/our account/s within the preceding ninety days for Savings and Terms Accounts, and 30 days for Demand Deposit accounts. I can also print the transaction history of my account/s if I/we want.

   3. Fund Transfers. I can only transfer funds from/to enrolled and related account/s. I can also add unrelated account/s by clicking the Unrelated Accounts link, but for security purposes, the unrelated account/s added will only be activated after 48 hours from creation. I fully understand that only the cleared and available balances of my/our enrolled and related accounts shall be allowed in this transaction. In case of insufficient funds in my/our enrolled account, my/our fund transfer request shall be denied automatically and no further attempt will be made by the Bank to make the request. The Bank shall not incur any liability or obligation if the request are not completed due to insufficiency of funds in my/our enrolled account.

   4. Bills Payment. The Bills payment is for paying my/our bills online to institutions with Bills Payment Collection Agreement with the Bank. By simply clicking the radio button in the FROM column of the account I want to transfer from and then the radio button in the PAYEE column of the institution I/we wanted to pay, I can immediately my/our bills online. I can customize the PAYEE column to include only those institutions where I frequently pay. The Bank shall advise me/us when enrollments of new institutions will be allowed. Payment to any of these institutions made through this facility shall be subject to the terms and conditions of this Agreement.

      • Payments made during system downtime shall be tagged as incomplete.

      • Only cleared and available balances of my/our enrolled account/s shall be allowed. In case of insufficient funds in my/our account my bills payment request will be cancelled automatically by the Bank.

      • The Bank shall not be liable for any discrepancy between the billing amount and the paid amount. The reconciliation shall be made between me/us and the payee - Institution.

      • I authorize the Bank to disclose to any of the payee - Institution/s any matter pertaining to my account/s as may be necessary for the operation of this Bills Payment transaction. I hereby held the Bank free and harmless from any and all liabilities, claims, demands, suits of whatever nature, arising from such disclosure.

      • I fully understand that payments shall be for current bills only; payments for past-due or overdue accounts with service disconnection or termination of contract or lapse of policy shall be made directly to the collection offices of the payee - institution/s. The Bank shall not incur liability for any adverse consequences instituted by any of the Institutions for payments made on overdue or past-due accounts, including payments for service disconnection, termination of contract, lapse of policy or the like.

      • The Bills Payment service arrangement between the Bank and the Institutions with existing Bills Payment Collection Agreement may be cancelled or terminated at any time by either of the party without any prior notice to me/us.

8. In all cases not specifically provide for in the foregoing or hereunder or otherwise by written agreement between me/us and the Bank, the usual customs and provisions common to all Banks in the Philippines shall exclusively govern all transactions between me/us and the Bank with regard to this facility. Accounts are also subject to such regulations as maybe imposed by the Bangko Sentral ng Pilipinas (BSP) relative to the establishment and operation of deposit accounts.

V. Cost and Venue of Suit

9. In case of any litigation arising from this facility, I shall pay the cost expenses and litigation and attorney's fees equivalent to twenty percent (20%) of the amount involved and in any case Five Thousand Pesos (P5,000.00) and any legal action in connection herewith shall be filed in the proper court of Metro Manila.

VI. Change of Terms and Conditions

10. I agree that the Bank has the absolute right to amend anytime any of the terms and conditions herein as it may deem necessary for the best interest of the Bank and Depositors, provided such additions, alterations and amendments are not contrary to banking laws and regulations of the Bangko Sentral ng Pilipinas , or by- Laws of the Bank. The amended Terms and Conditions, rules and regulations arising thereupon shall be communicated to me/us thru my designated e-mail address, or in such other form or manner determined by the Bank.

VII. Separability of Provisions

11. I agree that should any of the stipulations herein be held invalid, the legality and enforceability of the remaining stipulations shall not in any way be affected or impaired.

VIII. Acceptance of Terms and Conditions

12. By using the this facility, I fully understood to have accepted the above conditions and any other additional regulations as the Bank may subsequently prescribe from time to time covering this facility.

13. I expressly agree that the use of this facility is at my/our own risk and shall assume all risks and delays incidental to or arising out of the use of this facility.

I hereby agree to be governed by the terms and conditions of EASTWEST BANK INTERNET BANKING AGREEMENT. I hereby also acknowledge to have read and fully understood the said terms and conditions.
